FIVE-PART TERMS • 1 / 51 / 5 — General Terms
Agreement & Scope
1. Agreement
These Terms & Conditions describe the general rules for website, app, design and digital-product work provided by Kanishk Online Studio. A project begins when both sides agree on the scope, pricing, delivery expectations and any applicable advance/payment arrangement.
2. Project Scope
Each project is based on the requirements confirmed with the customer. Features, pages, integrations, content responsibilities and delivery items should be clearly agreed before development.
3. Starting Prices
Prices displayed on the website are starting estimates. A final quotation can vary according to scope, design complexity, third-party services, integrations, content, domain, hosting and publishing requirements.
4. Requirement Changes
Requests added after scope confirmation may affect price, delivery time or both. New work should be approved before it is treated as part of the project.
5. Customer Responsibilities
Customers are responsible for providing accurate business information, content, logos, images and other materials they have the right to use.
FIVE-PART TERMS • 2 / 52 / 5 — Payments & Third-Party Services
Money, Domains & External Platforms
1. Payment Schedule
Payment stages, advance amounts and final balances are agreed for each project. Work may be paused when an agreed payment is overdue.
2. Third-Party Costs
Domain names, hosting, premium plugins, app-store accounts, payment gateways, APIs, email providers, stock media and other external services can have separate charges.
3. External Accounts
Where an account belongs to the customer, the customer should provide required access through an appropriate secure method and remain responsible for the account's ownership and billing.
4. Refunds & Cancellations
Refund or cancellation treatment depends on the agreed commercial terms, the stage of work and any non-refundable third-party costs already incurred. The final quotation should state project-specific rules.
5. Taxes
Any applicable taxes or statutory charges are handled according to the final quotation and applicable law.
FIVE-PART TERMS • 3 / 53 / 5 — Delivery, Revisions & Approval
Development Workflow
1. Design Review
The customer may review agreed design directions and provide consolidated feedback during the review stage.
2. Revisions
The number and type of revisions depend on the chosen package or quotation. Material changes to an approved direction can be treated as additional scope.
3. Testing
Before launch, the project is tested against the agreed target browsers, screen sizes and core functionality. Third-party limitations are outside the studio's direct control.
4. Delivery
A project is considered ready for handover when the agreed deliverables are completed or when the customer approves the final version.
5. Delays
Delays can occur when required content, approvals, access, payments or third-party services are not available in time. External outages or platform review times may also affect schedules.
FIVE-PART TERMS • 4 / 54 / 5 — Intellectual Property, Privacy & Acceptable Use
Rights & Data
1. Customer Content
The customer retains rights to content they supply, subject to any licences that apply.
2. Project Assets
Ownership or licensing of source code, design files, premium assets and third-party components follows the final quotation or written agreement.
3. Lawful Use
Customers must not request unlawful, fraudulent, harmful or infringing functionality or content.
4. Privacy
Personal information submitted through the website is used to respond to project requests, provide support and operate relevant order-tracking functionality. See the privacy policy when published for the fuller data practices.
5. Security Limits
Reasonable technical safeguards are used, but no internet service can be promised to be completely immune from every possible security threat.
FIVE-PART TERMS • 5 / 55 / 5 — Support, Liability & Final Terms
After Launch & Legal
1. Support
Post-launch support, maintenance and update work may be included or billed separately depending on the agreed package.
2. No Guaranteed Results
The studio does not guarantee sales, search rankings, advertising results, app-store approval, revenue or any specific business outcome unless expressly agreed in writing.
3. Liability
To the extent allowed by applicable law, responsibility is limited to the agreed project scope and the direct services supplied. Consequential or indirect losses may be excluded where legally permitted.
4. Termination
Either side may seek to end a project under the agreed commercial terms. Work completed and approved third-party expenses remain subject to the applicable payment obligations.
5. Changes to These Terms
These general terms may be updated for future projects. Project-specific written agreements or quotations control where they differ from these general website terms.
